- Thai International Rent a Car Co., Ltd. or Avis Rent a Car Thailand (“Company”) has established an internet car rental reservation system and online credit card payment whereby the renter shall make a reservation and pay car rental fee with his/her credit card through internet, hereinafter called the “Online Payment” or the “System”. Reservation by this System is completed only after the renter has paid the rental fee through the Online Payment and received a reservation confirmation number from the system.
- The renter hereby acknowledges that his/her credit card data provided for payment through Online Payment will be kept confidential by a payment gateway of The Siam Commercial Bank PLC. The Siam Commercial Bank PLC will verify credit card data and collect the rental fee from the renter’s credit card number provided. The Company has neither obligation to verify the renter’s credit card data nor involvement in any way in the renter’s credit card data.
- The renter making reservation and payment through the System hereby understands and agrees to the terms and conditions of the Online Payment in order to be entitled to a special rate, the payment of which is immediately paid upon making reservation. The renter is not compelled by the Company to make a reservation and payment through the System. If reservation or payment through the System is in any way not convenient for the Renter, the Company has made available other booking options in addition to Online Payment, for instance, booking without prepaid requirement, booking by telephone by calling the Company’s Call Center.
For the purpose of this Online Payment, the renter refers to a person specified in the reservation as driver and who owns the credit card used for Online Payment. In this regard, the renter shall possess following qualifications and documents to be entitled to the rent and pick up the car:
- The renter shall be 23 years old or older and possess a valid driver’s license;
- The renter shall have an ID card (for Thais) or a valid passport (for foreigners); and
- The renter shall have a credit card having credit sufficient for the rental fee payment and authorization of security deposit according to the Company’s regulations.
- The Company shall be responsible for preparing a car and other accessories according to the renter’s reservation through Online Payment, for instance, petrol, supplementary travel gears and insurance upon receipt of reservation through Online Payment. The Company shall prepare a car for the renter at the location and time specified by the renter in the System. However, the renter is required to make reservation and payment through the Online Payment system at least 48 hours before the service. In case where the renter makes a reservation or payment through Online System in the period less than 48 hours, the system will not accept such reservations.
In case of an error or damage from reservation through the Online Payment system, the Company shall be responsible only for refunding the rental fee charged to the renter.
- The renter hereby acknowledges that a special rate on the Online Payment system is limited and subject to random system specified in the Company’s System. The special rate is offered occasionally which varies depending on certain period and each location and is subject to change at anytime. The Company reserves its right at its discretion to change quantity, prices or conditions as it deems appropriate. The renter cannot claim a special discount rate shown in the system if the renter has not yet made payment through the Online Payment system and received a reservation confirmation number.
- The renter agrees to pay for the rental fee by his/her credit card, allowing the Company to charge the rental fee to his/her credit card account as notified at the time of reservation. Reservation by this System is completed only after the rental fee has been paid through the SCB’s Payment Gateway and the renter has received a reservation confirmation number from the system. The renter shall record the reservation confirmation number, reservation details and rental fee payment as evidence for car pick up at the location and time reserved.
- The renter shall present the following documents according to the Company’s car rental conditions to identify the renter:
- A valid driver license of the renter and an additional driver (if any);
- ID card (for Thais) or a valid passport (for foreigners) of the renter and an additional driver (if any);
- The renter’s credit card having credit sufficient to pay for the rental fee and authorization of the security deposit according to the Company’s regulations; and
- The reservation confirmation number or reservation document.
In case the renter cannot provide ALL of the documents mentioned above, the Company reserves its right to cancel the service. It is deemed as the renter’s fault for not preparing all the documents earlier notified by the Company. In such a case, the Company will charge 30% fees of the total rental fee and return the balance to the renter.
- In case the renter wishes to amend the reservation, for example, type of the car, location, time, driver’s name, additional driver’s name or other additional services from those previously reserved through Online Payment, the renter is required to notify the Company at least 24 hours before the renter is scheduled to pick up the car as previously reserved. The renter shall notify the Call Center at 02-251 1131 or 02-251 1132 during office hours, 8.30 a.m. to 6.00 p.m. The renter acknowledges and agrees to absorb the fee to be charged for each reservation amendment at 20% of the total rental fee. The renter also agrees that the Company is entitled to charge such fee to the renter.
In case the renter notifies the Company of the change in less than 24 hours resulting in expenses incurred to the Company for car preparation and loss of opportunity to rent such car to other renters, the renter allows the Company to charge him/her at 30% of the total rental fee, by charging to his/her credit card account, notified at the time of making reservation through the Online Payment system. The renter further acknowledges that if the renter makes a sudden change to the reservation in less than 24 hours, the Company may not be able to provide a car according to the renter’s need. The Company reserves its rights as deemed appropriate.
- In case the renter wishes to cancel the reservation, the renter is required to notify the Company at least 24 hours before the renter is scheduled to pick up the car as previously reserved through Online Payment. The renter shall notify the Call Center at 02-251 1131 or 02-251 1132 during office hours, 8.30 a.m. to 6.00 p.m. The renter acknowledges and agrees to absorb the cancellation fee to be charged at 30% of the total rental fee. The renter also agrees that the Company is entitled to charge such fee to the renter.
In case the renter cancels his/her reservation in less than 24 hours or fails to cancel it, the Company reserves its rights, at its sole and absolute discretion, not to refund any amount paid. The Company may, at its sole and absolute discretion, consider refunding part of the rental fee to the renter. Notwithstanding that, the Company reserves its right to charge cancellation fee.
- In case the renter wishes to extend the rental period reserved through the Online Payment system, the renter acknowledges and agrees that the rental rate for the extended period may differ from that reserved through the Online Payment system. To extend the rent period, the renter is required to contact the Call Center or the location where the renter picks up the car. The Call Center or staff has the right to quote a rental rate as the Company deems appropriate and the renter does not have the right to apply any other rental rate. In case the renter fails to return the car within the rental period made through Online Payment and fails to notify the Company of his/her wish to extend the rent, the Company has the right to charge the highest rate or standard rate at the Company’s discretion as the Company deems appropriate.
- In case the Company cannot provide the car according to the renter’s needs, reservation and payment through the Online Payment system, the renter agrees that the Company provides a substitute car similar or better than the reservation car, based on the rental rate. Changing the type of car or car upgrade shall be in line with the Company’s standard and discretion without prior notice to the renter.
In case the Company cannot provide a substitute car by any means to the renter, the renter agrees that the Company may, at its sole and absolute discretion, refund the total rental fee. the renter hereby agrees that such refund is deemed as full and complete responsibility of the Company and shall be final. The renter agrees to release and discharge the Company from any other responsibilities. The Company will notify the renter 24 hours before the scheduled pickup time, specified at the reservation in case of refund because the Company cannot find a car or substitute for the renter.
- The renter shall take care of the car and equipment according to the Company’s normal usage conditions. The renter shall drive on normal roads, not to violate legal provisions or traffic law as well as not to use the car in a dishonest way. And the renter shall be responsible for damage to the car and its equipment at the highest rate determine by the Company. The renter acknowledges and agrees with the Company’s terms and conditions applicable to reservation and use of services. The renter agrees that the Company is entitled to cancel the insurance and the Company shall refund the renter in case the Company is suspicious of the renter’s use of the car. The Company has the right to demand compensation for damage to the Company’s car and its equipment in full. The renter is obligated to return the car to the Company or Company’s employees for inspection. If the Company deems appropriate to cancel the service to the renter as he/she uses the car in contradiction with the Company’s terms and conditions, the renter allows the Company to cancel the service immediately regardless of whether the rent period is not completed.
- In case of an accident or damage to the rented car, equipment or properties of the Company, the renter agrees to be responsible and liable for any damages caused by the renter, driver, additional driver or anyone who uses the car, or for any loss or damage to the Company’s equipment or properties. The renter shall notify the Company of the damage or loss within 6 hours from the time the renter is aware of the damage or loss. The renter shall also describe the damage or loss, location, time and the other party, considered significant for the renter to be entitled to insurance coverage. However, the insurance may not cover the renter if the renter fails to notify the Company of the damage or loss by the schedule specified or fails to describe the damage or loss or the renter misuses the car, its equipment or other properties, or the renter deliberately causes damage or loss to the Company’s properties. In such cases, the renter agrees to be responsible and liable for such damages or losses at the maximum compensation amount or rate claimed by the Company.
- The renter hereby accepts conditions and other requirements that are not specified herein which are the Company’s standard conditions and requirements, shown reverse side of the rental agreement to be provided to the renter at the time the renter signs the car rental agreement with the Company’s staff.
- In case of dispute or the Company and the renter have different opinions on an issues, the renter agrees to comply with the Company’s determination, which considers final.
Remarks:
To make a reservation and check the rental rate through the Online Payment system on the Company’s website, the renter may check the rate more than once. Checking the rental rate and offering such personal data as name, location, time, traveling time, type of car, etc. shall be processed through a random of a rental rate available in the system. However, the reservation, random pricing and the rental rates shown are for information for the renter’s decision only. They are not conditions or obligations that commit the renter to make reservation and payment through the Online Payment system. In other words, the final decision to make a reservation and payment rests with the renter and payment condition at the time of reservation. Service conditions shall be according to the time fixed by the renter at the reservation.
- บริษัท ไทยอินเตอร์เนชั่นแนล เรนท์ อะ คาร์ จำกัด หรือ Avis Rent A Car Thailand (บริษัทฯ) ได้สร้างระบบการจองรถเช่าและชำระค่าบริการผ่านบัตรเครดิตล่วงหน้า โดยผู้เช่าจะต้องทำการจองและชำระค่าบริการโดยบัตรเครดิตผ่านระบบ Internet ซึ่งบริษัทฯเรียกว่าระบบ Online Payment การจองด้วยระบบดังกล่าวจะเสร็จสมบูรณ์เมื่อผู้ใช้บริการได้ทำการชำระค่าบริการตามระบบและได้รับหมายเลขยืนยันการจองจากระบบ แล้วเท่านั้น
- ผู้เช่ารับทราบว่าข้อมูลเกี่ยวกับบัตรเครดิตของผู้เช่าในการชำระค่าบริการผ่านระบบ Online Payment ที่ผู้เช่าได้ระบุลงในระบบจะถูกเก็บรักษาเป็นความลับด้วยระบบ Payment Gateway ของธนาคารไทยพาณิชย์ซึ่งจะเป็นผู้ดำเนินการเรียกเก็บค่าบริการจากบัตรเครดิตตามที่ผู้เช่าได้แจ้งหมายเลขบัตรเครดิตไว้ โดยที่บริษัทฯมิได้เป็นผู้ดำเนินการเกี่ยวกับข้อมูลใดๆทั้งสิ้น
- ผู้เช่าที่ได้ทำการจองและชำระค่าบริการล่วงหน้าตามระบบ Online Payment เพื่อให้ได้สิทธิราคาพิเศษนี้เข้าใจและยอมรับข้อตกลงในการจองและชำระค่าบริการผ่านระบบ ซึ่งจะเป็นการชำระค่าบริการทันที ณ เวลาที่ทำการจอง โดยที่บริษัทฯมิได้บังคับให้ผู้เช่าทำการจองโดยวิธีการชำระค่าบริการล่วงหน้าตามระบบ Online Payment ซึ่งนอกจากการจองด้วยระบบนี้แล้ว บริษัทฯยังมีวิธีการจองโดยวิธีอื่นๆเพื่อให้บริการอีกหลายวิธีถ้าผู้เช่าไม่สะดวกกับระบบ เช่น วิธีการจองโดยไม่ต้องชำระค่าบริการล่วงหน้า และวิธีการจองทางโทรศัพท์โดยติดต่อไปยัง Call Center ของบริษัทฯ
ผู้เช่าในที่นี้หมายถึงผู้ที่ระบุชื่อในการจองที่จะเป็นผู้ขับรถและยังต้องเป็นเจ้าของบัตรเครดิตที่ใช้ชำระค่าบริการ อีกทั้งผู้เช่าต้องมีเอกสารสำคัญเพื่อประกอบการเช่ารถและการตรวจรับรถดังต่อไปนี้คือ
- ผู้เช่าต้องมีอายุตั้งแต่ 23 ปีขึ้นไปและมีใบขับขี่รถยนต์ที่ยังไม่หมดอายุ
- ผู้เช่าต้องมีบัตรประจำตัวประชาชน (ชาวไทย) หรือหนังสือเดินทางที่ยังไม่หมดอายุ (ชาวต่างประเทศ)
- ผู้เช่าต้องมีบัตรเครดิตที่ใช้ชำระค่าบริการของผู้เช่าสำหรับขออนุมัติวงเงินค้ำประกันการเช่าตามระเบียบของบริษัทฯ
- บริษัทฯมีหน้าที่เตรียมการบริการซึ่งได้แก่ รถยนต์และส่วนประกอบอื่นๆตามการจองของผู้เช่า เช่น น้ำมัน อุปกรณ์เสริมในการเดินทาง และการประกันภัย เมื่อได้รับข้อมูลการจองจากผู้เช่าผ่านทางระบบ Online Payment ทั้งนี้บริษัทฯจะทำการเตรียมรถยนต์เพื่อให้บริการแก่ผู้เช่าตามสถานที่และเวลาที่ผู้เช่าได้ระบุ โดยที่ผู้เช่าต้องทำการจองและชำระค่าบริการผ่านระบบ Online Payment ก่อนกำหนดการที่จะใช้บริการล่วงหน้า 48 ชั่วโมงเป็นอย่างต่ำ ในกรณีที่น้อยกว่า 48 ชั่วโมงระบบจะไม่เปิดให้ทำการจอง
ในกรณีที่เกิดความผิดพลาดหรือความเสียหายจากการใช้วิธีการจองโดยระบบ Online Payment บริษัทฯจะรับผิดชอบด้วยวิธีการคืนเงินค่าบริการให้แก่ผู้เช่าเพื่อเป็นการชดเชยเท่านั้น
- ผู้เช่ารับทราบว่าราคาพิเศษตามระบบ Online Payment มีจำนวนจำกัดตามแต่ระบบของทางบริษัทฯจะสุ่มเลือกขึ้นมาตามจำนวนที่บริษัทฯได้กำหนดเอาไว้ในระบบ ราคาพิเศษในแต่ละช่วงเวลาและสถานที่อาจจะไม่เท่ากันและมีการเปลี่ยนแปลงได้ตลอดเวลา บริษัทฯขอสงวนสิทธิ์ในการเปลี่ยนแปลงจำนวน, ราคา หรือเงื่อนไขต่างๆตามที่บริษัทฯเห็นสมควร ทั้งนี้ผู้เช่าไม่สามารถอ้างถึงราคาพิเศษตามที่ระบบแสดงให้เห็นโดยที่ผู้เช่ายังมิได้มีการชำระค่าบริการด้วยระบบ Online Payment และได้รับหมายเลขยืนยันการจองจากระบบ
- ผู้เช่าตามระบบ Online Payment ยินยอมและตกลงชำระค่าบริการผ่านบัตรเครดิตของผู้เช่าโดยอนุญาตให้บริษัทฯหักค่าบริการนี้จากบัญชีบัตรเครดิตที่ได้แจ้งไว้ ณ ขณะที่ทำการจอง และจะถือว่าการจองเสร็จสมบูรณ์ต่อเมื่อได้ชำระค่าบริการผ่านระบบ Payment Gateway ของธนาคารและได้รับหมายเลขยืนยันการจองจากระบบ ผู้เช่ามีหน้าที่จดบันทึกหรือพิมพ์หมายเลขยืนยันการจองและรายละเอียดในการจองและชำระค่าบริการ เพื่อเป็นเอกสารประกอบในการรับรถตามสถานที่และเวลาที่ผู้เช่าได้ทำการจองไว้
- ผู้เช่ามีหน้าที่เตรียมเอกสารที่จำเป็นสำหรับการใช้บริการตามเงื่อนไขปกติของการเช่ารถของบริษัทฯ เพื่อเป็นการยืนยันตัวตนที่แท้จริงตามเอกสารต่อไปนี้คือ
- ใบขับขี่รถยนต์ที่ยังไม่หมดอายุของผู้ผู้เช่าและของผู้ขับเสริม (ถ้ามี)
- บัตรประจำตัวประชาชน (ชาวไทย) หรือหนังสือเดินทางที่ยังไม่หมดอายุ (ชาวต่างประเทศ) ของผู้เช่าและของผู้ขับเสริม (ถ้ามี)
- บัตรเครดิตของผู้เช่าที่ใช้ชำระค่าบริการ
- หมายเลขยืนยันการจอง หรือ เอกสารยืนยันการจอง
ในกรณีที่ผู้เช่าไม่มีเอกสารดังกล่าวข้างต้นหรือมีไม่ครบ บริษัทฯขอสงวนสิทธิ์ยกเลิกการให้บริการโดยถือว่าเป็นความผิดของผู้เช่าเองที่ไม่เตรียมเอกสารให้พร้อมเมื่อมาใช้บริการตามที่บริษัทฯได้แจ้งให้ทราบแล้ว ทั้งนี้บริษัทฯจะคิดค่าธรรมเนียมในอัตรา 30% ของยอดค่าบริการทั้งหมดและคืนค่าบริการส่วนที่เหลือให้ผู้เช่า
- ในกรณีที่ผู้เช่าต้องการเปลี่ยนแปลงรายละเอียดต่างๆ เช่น ประเภทรถ, สถานที่, เวลา, ชื่อผู้ขับรถ, ชื่อผู้ขับเสริม หรือบริการเพิ่มเติมอื่นๆ ตามที่ผู้เช่าได้ทำการจองแล้ว ผู้เช่าต้องแจ้งให้บริษัทฯทราบล่วงหน้าอย่างน้อย 24 ชั่วโมงก่อนเวลาที่ผู้เช่าได้กำหนดว่าจะเช่ารถตามที่จองเมื่อเริ่มแรก โดยผู้เช่าต้องแจ้งไปยัง Call Center ที่หมายเลขโทรศัพท์ 02-251 1131, 02-251 1132 ในระหว่างเวลาทำการ 08.30 น. ถึง 18.00 น. ทั้งนี้ผู้เช่ารับทราบและยินยอมรับผิดชอบค่าธรรมเนียมจากการเปลี่ยนแปลงในอัตรา 20% ของยอดค่าบริการทั้งหมดต่อการเปลี่ยนแปลงรายละเอียดการใช้รถ 1 ครั้ง โดยผู้เช่ายินยอมและตกลงให้สิทธิ์แก่บริษัทฯในการเรียกเก็บค่าธรรมเนียมดังกล่าว โดยการตัดจากมูลค่าการจองหรือยอดการเรียกเก็บจากผู้เช่าโดยตรงเมื่อรับรถ
ในกรณีที่ผู้เช่าได้แจ้งถึงการเปลี่ยนแปลงล่วงหน้าเป็นเวลาน้อยกว่า 24 ชั่วโมงซึ่งทำให้เกิดค่าใช้จ่ายขึ้นแก่บริษัทฯในการจัดเตรียมรถยนต์ และไม่สามารถนำรถยนต์คันดังกล่าวไปให้บริการแก่ผู้เช่ารายอื่นได้ ผู้เช่าให้สิทธิ์บริษัทฯในการคิดค่าธรรมเนียมในอัตรา 30% ของยอดค่าบริการทั้งหมดของผู้เช่ารายนั้น โดยหักจากบัญชีบัตรเครดิตที่ผู้เช่าได้แจ้งไว้เมื่อทำการจองในระบบ Online Payment และผู้เช่ารับทราบว่าบริษัทฯอาจไม่สามารถเตรียมรถเพื่อบริการผู้เช่าได้ตามความต้องการ ถ้าผู้เช่ามีการเปลี่ยนแปลงกะทันหันล่วงหน้าน้อยกว่า 24 ชั่วโมง บริษัทฯขอสงวนสิทธิ์ในการดำเนินการตามที่บริษัทฯเห็นสมควร
- ผู้เช่ายินยอมและตกลงตามเงื่อนไขในกรณีที่ผู้เช่าต้องการยกเลิกการจองล่วงหน้าไม่น้อยกว่า 24 ชั่วโมง ซึ่งจะมีค่าธรรมเนียมการยกเลิกในอัตรา 30% ของยอดค่าบริการทั้งหมดของผู้เช่าตามที่ได้ทำการจองและชำระค่าบริการในระบบ Online Payment
ในกรณีที่ผู้เช่าได้แจ้งยกเลิกเป็นเวลาน้อยกว่า 24 ชั่วโมงหรือผู้เช่าไม่ได้แจ้งยกเลิก บริษัทฯขอสงวนสิทธิ์ในการไม่คืนเงินค่าบริการทั้งหมดให้แก่ผู้เช่า ยกเว้นกรณีมีเหตุสุดวิสัยให้ขึ้นอยู่กับดุลพินิจของทางบริษัทฯที่จะให้คืนเฉพาะส่วนที่ทางบริษัทฯเห็นสมควร โดยที่บริษัทฯยังมีสิทธิ์คิดค่าธรรมเนียมจากผู้เช่า
- ในกรณีที่ผู้เช่าต้องการใช้รถยนต์ยาวนานเกินกว่าระยะเวลาตามที่ได้ทำการจองและชำระค่าบริการในระบบ Online Payment ผู้เช่ารับทราบ และตกลงยินยอมว่าราคาของวันที่เช่าเพิ่มขึ้นจากที่ได้ระบุไว้ในใบจองนั้นจะไม่ใช่ราคาตามที่ผู้เช่าได้รับจากการจองผ่านระบบ ทั้งนี้ผู้เช่ามีหน้าที่ติดต่อแจ้งให้ Call Center หรือสถานที่ที่ผู้เช่าได้รับบริการหรือสาขาที่ได้รับรถเช่าไปเพื่อแจ้งความประสงค์ในการยืดระยะเวลาการเช่าต่อไป โดย Call Center หรือพนักงานของบริษัทฯมีสิทธิเสนอราคาค่าบริการตามที่บริษัทฯเห็นสมควร โดยผู้เช่าไม่มีสิทธิเลือกราคาตามที่ผู้เช่าต้องการได้ ในกรณีที่ผู้เช่าไม่ยอมคืนรถตามกำหนดที่ได้ระบุไว้ในระบบการจองและไม่ได้แจ้งกับทางบริษัทฯให้ทราบว่าจะขยายระยะเวลาการเช่ารถออกไป บริษัทฯมีสิทธิ์ที่จะคิดค่าบริการในอัตราสูงสุดหรืออัตราปกติตามที่บริษัทฯเห็นสมควร
- ในกรณีที่บริษัทฯไม่สามารถจัดหารถยนต์ให้ตรงตามประเภทที่ผู้เช่าได้ทำการจองและชำระค่าบริการผ่านระบบ Online Payment ผู้เช่ายินยอมให้บริษัทฯสามารถจัดรถทดแทนในประเภทที่ใกล้เคียงหรือดีกว่าเพื่อให้บริการได้ โดยเปรียบเทียบจากราคาค่าบริการเป็นหลัก ทั้งนี้การเปลี่ยนแปลงประเภทรถยนต์หรือการเลื่อนระดับชั้นของประเภทรถยนต์จะเป็นไปตามมาตรฐานของบริษัทฯโดยไม่ต้องแจ้งให้ผู้เช่าทราบล่วงหน้า
ในกรณีที่บริษัทฯไม่สามารถจัดหารถทดแทนใดๆให้แก่ผู้เช่าได้เลย ผู้เช่ายินยอมให้สิทธิ์แก่บริษัทฯดำเนินการคืนเงินค่าบริการให้เต็มจำนวนโดยถือเป็นความรับผิดชอบต่อการจองใช้บริการและให้ถือเป็นการสิ้นสุดของการเรียกร้อง ซึ่งบริษัทฯจะแจ้งให้ผู้เช่าได้ทราบล่วงหน้า 24 ชั่วโมงก่อนเวลาที่ผู้เช่าได้ระบุไว้ในการจองหากต้องคืนเงินเนื่องจากบริษัทฯไม่สามารถจัดหารถหรือรถทดแทนให้แก่ผู้เช่าได้
- ผู้เช่ามีหน้าที่ดูแลรักษารถยนต์และอุปกรณ์ต่างๆของบริษัทฯตามเงื่อนไขในการใช้รถยนต์ของบริษัทฯตามปกติ โดยผู้เช่าต้องขับรถยนต์บนสภาพถนนปกติและไม่ฝ่าฝืนกฎหมายและกฎจราจร รวมทั้งไม่ใช้รถยนต์ไปในทางมิชอบ และผู้เช่าต้องเป็นผู้รับผิดชอบความเสียหายของรถยนต์และอุปกรณ์ต่างๆในอัตราสูงสุดตามที่บริษัทฯกำหนด ผู้เช่าทราบและได้ตกลงตามเงื่อนไขในการจองและการใช้บริการตามเงื่อนไขปกติของบริษัทฯ ผู้เช่าตกลงให้สิทธิ์แก่บริษัทฯในการยกเลิกการบริการด้านการประกันภัย โดยบริษัทฯจะทำการคืนเงินแก่ผู้เช่าในกรณีที่บริษัทฯเกิดความสงสัยในการใช้รถยนต์ของบริษัทฯ และบริษัทฯมีสิทธิเรียกร้องค่าเสียหายเต็มจำนวนที่เกิดขึ้นกับรถยนต์และและอุปกรณ์ต่างๆของบริษัทฯ รวมทั้งผู้เช่ามีหน้าที่นำรถยนต์ของบริษัทฯมาให้พนักงานของบริษัทฯทำการตรวจสอบ และหากบริษัทฯเห็นสมควรในการยกเลิกการให้บริการแก่ผู้เช่ารายนั้นเนื่องจากการใช้รถยนต์และอุปกรณ์ต่างๆขัดกับเงื่อนไขของบริษัทฯ ผู้เช่าให้สิทธิ์บริษัทฯในการยกเลิกการให้บริการได้ทันที แม้ระยะเวลาในการเช่าจะยังไม่สิ้นสุดก็ตาม
- ในกรณีที่เกิดอุบัติเหตุหรือเกิดความเสียหายขึ้นกับรถที่เช่า, อุปกรณ์ต่างๆหรือทรัพย์สินของบริษัทฯ ผู้เช่ามีหน้าที่รับผิดชอบในความเสียหายซึ่งเกิดจากผู้เช่าเอง, ผู้ขับ, ผู้ขับเสริม หรือผู้อื่นที่ใช้รถยนต์, อุปกรณ์ต่างๆหรือทรัพย์สินของบริษัทฯสำหรับความเสียหายและการสูญหายซึ่งทรัพย์สินของบริษัทฯ โดยผู้เช่ามีหน้าที่ต้องแจ้งให้บริษัทฯทราบถึงความเสียหายหรือการสูญหายดังกล่าวภายใน 6 ชั่วโมงนับจากที่ผู้เช่าทราบถึงความเสียหายหรือการสูญหายที่เกิดขึ้น โดยผู้เช่าจะต้องแจ้งรายละเอียดความเสียหายหรือการสูญหาย สถานที่ เวลา และคู่กรณี ซึ่งเป็นส่วนสำคัญที่ผู้เช่าจะได้สิทธิ์คุ้มครองจากการประกันภัย ทั้งนี้การประกันภัยจะไม่คุ้มครองผู้เช่าถ้าผู้เช่าไม่แจ้งให้บริษัทฯทราบถึงความเสียหายหรือการสูญหายในระยะเวลาที่บริษัทฯกำหนด หรือผู้เช่าไม่ให้รายละเอียดความเสียหายหรือการสูญหาย หรือผู้เช่าใช้รถยนต์, อุปกรณ์ต่างๆหรือทรัพย์สินของบริษัทฯผิดประเภท หรือผู้เช่ามีเจตนาทำให้ทรัพย์สินของบริษัทฯเสียหายหรือสูญหาย ผู้เช่าต้องรับผิดชอบสูงสุดตามที่บริษัทฯเรียกร้อง
- ผู้เช่ายอมรับเงื่อนไขและข้อกำหนดอื่นๆที่มิได้ระบุอยู่ในเงื่อนไขและข้อกำหนดฉบับนี้ ซึ่งเป็นเงื่อนไขและข้อกำหนดตามมาตรฐานของบริษัทฯตามที่ปรากฏอยู่ด้านหลังของสัญญาการเช่ารถ โดยที่ผู้เช่าจะได้รับทราบ ณ เวลาที่ผู้เช่าลงชื่อในสัญญาเช่าต่อหน้าพนักงานของบริษัทฯ
ในกรณีที่ทางบริษัทฯและผู้เช่ามีความคิดเห็นไม่ตรงกัน ผู้เช่ายินยอมที่จะปฏิบัติตามความคิดเห็นของบริษัทฯซึ่งถือเป็นการสิ้นสุด
หมายเหตุ
ในการจองและการตรวจสอบราคาที่ผู้เช่าได้ทำการจองและชำระเงินผ่านระบบ Online Payment บน Website ของบริษัทฯ ผู้เช่าสามารถตรวจสอบราคาที่ผู้ให้บริการกำหนดตามลำดับต่างๆได้มากกว่า 1 ครั้ง อนึ่งการตรวจสอบราคาและการให้ข้อมูลส่วนตัว เช่น ชื่อ สถานที่ เวลา ระยะเวลาการเดินทาง ประเภทรถที่ใช้ เป็นต้น ซึ่งขอเรียกในที่นี้ว่าเป็นการสุ่มของข้อมูลราคาจากระบบ โดยเป็นการสุ่มราคาจากราคาที่มีในระบบด้วยการ Random ทั้งนี้ระบบการจองและระบบการสุ่มราคา รวมถึงระบบการแสดงราคาเป็นส่วนที่บริษัทฯและ Website ของบริษัทฯได้แสดงไว้เพื่อประกอบการตัดสินใจ โดยมิได้มีเงื่อนไขและข้อผูกมัดที่บังคับให้ผู้เช่าใช้บริการทำการจองและชำระเงินผ่านระบบดังกล่าว กล่าวคือการตัดสินใจขั้นสุดท้ายในการจองและชำระเงินเพื่อใช้บริการตามเงื่อนไขและวิธีการจองเป็นสิทธิและการยอมรับของผู้เช่า และขึ้นกับเงื่อนไขในการชำระเงินซึ่งเป็นการชำระเงินวันที่ ณ เวลาที่ทำการจอง ทั้งนี้เงื่อนไขในการใช้การบริการเป็นไปตามเวลาที่ผู้เช่าได้ระบุไว้ในการจอง
