1. Thai International Rent a Car Co., Ltd. or Avis Rent a Car Thailand (“Company”) has established an internet car rental reservation system and online credit card payment whereby the renter shall make a reservation and pay car rental fee with his/her credit card through internet, hereinafter called the “Online Payment” or the “System”. Reservation by this System is completed only after the renter has paid the rental fee through the Online Payment and received a reservation confirmation number from the system.

2. The renter refers to a person specified in the reservation as driver and who owns the credit card used for Online Payment. In this regard, the renter is required to verify the renting on the pickup date by present required document as follow.
   • The minimum renter age is 21 years.
   • Valid ID card (Thai Residence) or a valid passport (Foreigner).
   • Valid Thai driving license (Thai) or International driving license (Foreigner) of the renter and additional driver (if any).
   • The renter’s credit card for the rental payment and for authorization of deposit.

**All documents must be an original, not a copy or photo. If the renter provides incomplete document on the pickup date or not qualify Company terms & conditions, Company reserves the right not allowed to rent a car and not to refund for the prepaid reservation amount**

3. The renter hereby acknowledges that his/her credit card data provided for payment through Online Payment will be kept confidential by a payment gateway of The Siam Commercial Bank PLC. The Siam Commercial Bank PLC will verify credit card data and collect the rental fee from the renter’s credit card number provided. The Company has neither obligation to verify the renter’s credit card data nor involvement in any way in the renter’s credit card data.

4. The renter hereby acknowledges that a special rate on the Online Payment system is limited and subject to specified in the Company’s System. The special rate is offered occasionally which varies depending on certain period and each location. The Company reserves its right at its discretion to change quantity, prices or conditions without prior notice. The renter consent to debit his/her credit card at time of reservation. The reservation success only after the payment is competed and received the reservation confirmation number. The renter cannot claim a special discount rate shown in the system if the renter has not yet made payment through the Online Payment system and received a reservation confirmation number.

5. The renter who makes reservation through Online Payment hereby understands and agrees to the terms and conditions of the Online Payment that the payment is immediately paid upon making reservation. The renter is not compelled by the Company to make the reservation by this method. There are other available methods to make the reservation for instance, online no prepayment and booking via the Company’s Call Center.
   

   In case of an error from reservation through the Online Payment system, the Company shall be responsible only for refunding the rental charged to the renter.

6. For rental modifications
   • The renter required to inform Company at least 24 hours prior pickup date via Avis Call center 02 251 1131 during office hour. The renter can modify the reservation for free 1 time and for pickup date modification, it should not exceed 3 months from the original pickup date of the booking and subject to car availability and also must pay the difference of the rental amount according to the rental rate of that time. For the next modification, the renter accepts modification charge at 20% of the total reservation amount of each modify.
   • If the renter modifies the rental duration shorter than the original reservation, the renter can substitute the rental fee with our optional services for example fuel service, GPS and etc. but cannot refund for cash.
   • If the renter modifies the rental duration longer than the original reservation, the renter acknowledges and accept that the rental rate of the additional date is different from the online rental rate. If the renter fails to inform the extension rental day, Company, at its total discretion, reserves the right to charge the highest or standard rental rate of the additional rental day.

7. For cancellations and No show
   • If the renter cancels the reservation 24 hours prior pickup time, the refund will be 70% of the total prepaid reservation amount.
   • If the renter cancels the reservation less than 24 hours or No show, it cannot be refunded.

8. In case the Company cannot provide the car according to the renter’s needs, reservation and payment through the Online Payment system, the renter agrees that the Company provides a substitute car similar or better than the reservation car, based on the rental rate. Changing the type of car or car upgrade shall be in line with the Company’s standard and discretion without prior notice to the renter. In case the Company cannot provide a substitute car by any means to the renter, the renter agrees that the Company may, at its sole and absolute discretion, refund the total rental fee. the renter hereby agrees that such refund is deemed as full and complete responsibility of the Company and shall be final. The renter agrees to release and discharge the Company from any other responsibilities. The Company will notify the renter before the pickup time, specified at the reservation in case of refund because the Company cannot find a car or substitute for the renter.

9. The renter shall take care of the car and equipment according to the Company’s normal usage conditions. The renter shall drive on normal roads, not to violate legal provisions or traffic law as well as not to use the car in a dishonest way. And the renter shall be responsible for damage to the car and its equipment at the highest rate determine by the Company. The renter acknowledges and agrees with the Company’s terms and conditions applicable to reservation and use of services. The renter agrees that the Company is entitled to cancel the insurance and the Company shall refund the renter in case the Company is suspicious of the renter’s use of the car. The Company has the right to demand compensation for damage to the Company’s car and its equipment in full. The renter is obligated to return the car to the Company or Company’s employees for inspection. If the Company deems appropriate to cancel the service to the renter as he/she uses the car in contradiction with the Company’s terms and conditions, the renter allows the Company to cancel the service immediately regardless of whether the rent period is not completed.

10. In case of an accident or damage to the rented car, equipment or properties of the Company, the renter agrees to be responsible and liable for any damages caused by the renter, driver, additional driver or anyone who uses the car, or for any loss or damage to the Company’s equipment or properties. The renter shall notify the Company of the damage or loss immediately from the time the renter is aware of the damage or loss. The renter shall also describe the damage or loss, location, time and the other party, considered significant for the renter to be entitled to insurance coverage. However, the insurance may not cover the renter if the renter fails to notify the Company of the damage or loss by the schedule specified or fails to describe the damage or loss or the renter misuses the car, its equipment or other properties, or the renter deliberately causes damage or loss to the Company’s properties. In such cases, the renter agrees to be responsible and liable for such damages or losses at the maximum compensation amount or rate claimed by the Company.

11. During weekend, holiday or a period that have many bookings, Avis reserves the right to confirm and ask for prepaid 1-3 days prior pickup date. Avis will give special discount for prepaid payment in order to reduce contact time with our staff at counter. Avis reserves the right to cancel booking that not confirm or cannot contact the mobile number provided on booking.

12. The renter hereby accepts conditions and other requirements that are not specified herein which are the Company’s standard conditions and requirements, shown on booking confirmation and on reverse side of the rental agreement to be provided to the renter at the time the renter signs the car rental agreement with the Company’s staff.

13. In case return the rent car after location office hour, free late return may not valid and the additional rental charge may applied.

In case of dispute or the Company and the renter have different opinions on an issue, the renter agrees to comply with the Company’s determination, which considers final.

1. บริษัท ไทยอินเตอร์เนชั่นแนล เรนท์ อะ คาร์ จำกัด หรือ Avis Rent A Car Thailand (บริษัทฯ) คือผู้ให้เช่า ได้สร้างระบบการจองรถเช่าและชำระค่าบริการผ่านบัตรเครดิตล่วงหน้า โดยผู้เช่าจะต้องทำการจองและชำระค่าบริการโดยบัตรเครดิตผ่านระบบ Internet ซึ่งบริษัทฯเรียกว่าระบบ Online Payment การจองด้วยระบบดังกล่าวจะเสร็จสมบูรณ์เมื่อผู้ใช้บริการได้ทำการชำระค่าบริการตามระบบและได้รับหมายเลขยืนยันการจองจากระบบ แล้วเท่านั้น

2. ผู้เช่าในที่นี้หมายถึงผู้ที่ระบุชื่อในการจองที่จะเป็นผู้ขับรถและยังต้องเป็นเจ้าของบัตรเครดิตที่ใช้ชำระค่าบริการ และผู้เช่าต้องแสดงเอกสารสำคัญ เพื่อยืนยันตัวตนและประกอบการรับรถ ดังต่อไปนี้
   • ผู้เช่าต้องมีอายุตั้งแต่ 21 ปีขึ้นไป
   • บัตรประจำตัวประชาชน (ชาวไทย) หรือหนังสือเดินทาง (ชาวต่างชาติ) ที่ยังไม่หมดอายุ
   • ใบขับขี่รถยนต์ (ชาวไทย) หรือใบขับขี่สากล (ชาวต่างชาติ) ไม่หมดอายุของผู้เช่า และของผู้ขับเสริม (ถ้ามี)บัตรเครดิตที่เป็นชื่อเดียวกับผู้เช่าที่ยังไม่หมดอายุ และมีวงเงินเพียงพอสำหรับการชำระค่าบริการ และการล็อควงเงิน

   **เอกสารทั้งหมดต้องเป็นตัวจริงเท่านั้น ไม่สามารถใช้สำเนา หรือรูปภาพแทนได้ กรณีผู้เช่าแสดงเอกสารหรือมีคุณสมบัติไม่ครบตามเงื่อนไขบริษัท ณ วันรับรถ บริษัทฯขอสงวนสิทธิ์ไม่ปล่อยรถให้เช่า และไม่คืนเงินค่าบริการทั้งหมดตามที่ได้ชำระมาแล้ว**

3. ผู้เช่ารับทราบว่าข้อมูลเกี่ยวกับบัตรเครดิตของผู้เช่าในการชำระค่าบริการผ่านระบบ Online Payment ที่ผู้เช่าได้ระบุลงในระบบจะถูกเก็บรักษาเป็นความลับด้วยระบบ Payment Gateway ของ ธนาคารไทยพาณิชย์ ซึ่งจะเป็นผู้ดำเนินการเรียกเก็บค่าบริการจากบัตรเครดิตตามที่ผู้เช่าได้แจ้งหมายเลขบัตรเครดิตไว้ โดยที่บริษัทฯมิได้เป็นผู้ดำเนินการเกี่ยวกับข้อมูลใดๆทั้งสิ้น

4. ผู้เช่ารับทราบว่าราคาพิเศษตามระบบ Online Payment มีจำนวนจำกัด ตามแต่ตามจำนวนที่บริษัทฯได้กำหนดไว้ ราคาพิเศษในแต่ละช่วงเวลาและสถานที่อาจจะไม่เท่ากัน และบริษัทฯขอสงวนสิทธิ์ในการเปลี่ยนแปลงจำนวน, ราคา หรือเงื่อนไขต่างๆ และผู้เช่ายินยอมและตกลงชำระค่าบริการผ่านบัตรเครดิตของผู้เช่าโดยอนุญาตให้บริษัทฯหักค่าบริการนี้จากบัญชีบัตรเครดิตที่ได้แจ้งไว้ ณ ขณะที่ทำการจอง และจะถือว่าการจองเสร็จสมบูรณ์ต่อเมื่อได้ชำระค่าบริการผ่านระบบ Payment Gateway ของธนาคารสำเร็จ และได้รับหมายเลขยืนยันการจองจากระบบแล้วเท่านั้น ทั้งนี้ผู้เช่าไม่สามารถอ้างถึงราคาพิเศษตามที่ระบบแสดงให้เห็นโดยที่ผู้เช่ายังมิได้มีการชำระค่าบริการด้วยระบบ Online Payment และได้รับหมายเลขยืนยันการจองจากระบบ

5. ผู้เช่าที่ได้ทำการจองและชำระค่าบริการล่วงหน้าตามระบบ Online Payment เข้าใจและยอมรับข้อตกลงในการจองและชำระค่าบริการผ่านระบบ ซึ่งจะเป็นการชำระค่าบริการทันที ณ เวลาที่ทำการจอง โดยที่บริษัทฯมิได้บังคับให้ผู้เช่าทำการจองโดยวิธีการชำระค่าบริการล่วงหน้าตามระบบ Online Payment ซึ่งนอกจากการจองด้วยระบบนี้แล้ว บริษัทฯยังมีวิธีการจองโดยวิธีอื่นๆเพื่อให้บริการอีกหลายวิธีถ้าผู้เช่าไม่สะดวกกับระบบ เช่น วิธีการจองโดยไม่ต้องชำระค่าบริการล่วงหน้า และวิธีการจองทางโทรศัพท์โดยติดต่อไปยัง Call Center ของบริษัทฯ
   

   ในกรณีที่เกิดความผิดพลาดจากการใช้วิธีการจองโดยระบบ Online Payment บริษัทฯจะรับผิดชอบด้วยวิธีการคืนเงินค่าบริการให้แก่ผู้เช่าเพื่อเป็นการชดเชยเท่านั้น

6. การเปลี่ยนแปลงการจอง
   • ผู้เช่าต้องแจ้งให้บริษัททราบ ผ่านทาง Avis Call Center 02-2511131 ในระหว่างเวลาทำการ อย่างน้อย 24 ชั่วโมง ก่อนเวลารับรถ ผู้เช่ามีสิทธิ์เปลี่ยนแปลงรายละเอียดการเช่า โดยไม่มีค่าธรรมเนียมได้ 1 ครั้ง ทั้งนี้สำหรับการเปลี่ยนแปลงวันที่รับรถจะต้องไม่เกิน 3 เดือน นับจากวันรับรถที่ได้ทำจองไว้ และขึ้นอยู่กับรถว่าง และผู้เช่าต้องรับผิดชอบชำระส่วนต่างตามมูลค่าราคาค่าเช่าในวันที่ใช้จริง สำหรับการเปลี่ยนแปลงครั้งต่อไป จะมีค่าธรรมเนียมการเปลี่ยนแปลง 20% ของยอดค่าบริการทั้งหมด ต่อครั้งการเปลี่ยนแปลง และผู้เช่ายิมยอมให้บริษัทเรียกเก็บค่าธรรมเนียมดังกล่าว
   • กรณีผู้เช่าต้องการเปลี่ยนแปลงจำนวนวันใช้รถยนต์น้อยกว่าจำนวนวันที่ทำจองไว้ ผู้เช่าสามารถเลือกเปลี่ยนมูลค่าค่าเช่า เป็นบริการเสริมอื่นแทนได้ เช่น บริการ น้ำมัน, GPS, ฯลฯ แต่ไม่สามารถขอคืนเป็นเงินสดได้
   • กรณีผู้เช่าต้องการใช้รถยนต์จำนวนวันมากกว่าระยะเวลาที่ได้ทำจองและชำระค่าบริการไว้แล้ว ผู้เช่ารับทราบและยินยอมว่าราคาของวันที่เช่าเพิ่มขึ้นจากที่ระบุไว้ในใบจองนั้น อาจไม่ใช่ราคาตามที่ผู้เช่าได้รับจากการจองผ่านระบบ ในกรณีที่ผู้เช่าไม่คืนรถตามกำหนดที่ระบุไว้และไม่ได้แจ้งให้ทางบริษัทฯทราบ บริษัทฯมีสิทธิ์ที่จะคิดค่าบริการในอัตราสูงสุดหรืออัตราปกติตามที่บริษัทฯเห็นสมควร

7. การยกเลิกการจอง และไม่มารับรถ
   • กรณียกเลิกการจองมากกว่า 24 ชั่วโมงก่อนเวลารับรถ ผู่เช่าจะได้รับการคืนเงิน 70% ของยอดค่าบริการทั้งหมดที่ชำระล่วงหน้ามาแล้ว
   • กรณียกเลิกการจองน้อยกว่า 24 ชั่วโมงก่อนเวลารับรถ หรือไม่มารับรถ บริษัทฯสงวนสิทธิ์ไม่คืนเงินค่าบริการทั้งหมดทุกกรณี

8. ในกรณีที่บริษัทฯไม่สามารถจัดหารถยนต์ให้ตรงตามประเภทที่ผู้เช่าได้ทำการจองและชำระค่าบริการผ่านระบบ Online Payment ผู้เช่ายินยอมให้บริษัทฯสามารถจัดรถทดแทนในประเภทที่ใกล้เคียงหรือดีกว่าเพื่อให้บริการได้ โดยเปรียบเทียบจากราคาค่าบริการเป็นหลัก ทั้งนี้การเปลี่ยนแปลงประเภทรถยนต์หรือการเลื่อนระดับชั้นของประเภทรถยนต์จะเป็นไปตามมาตรฐานของบริษัทฯโดยไม่ต้องแจ้งให้ผู้เช่าทราบล่วงหน้า-กรณีที่บริษัทฯไม่สามารถจัดหารถทดแทนใดๆให้แก่ผู้เช่าได้เลย ผู้เช่ายินยอมให้สิทธิ์แก่บริษัทฯดำเนินการคืนเงินค่าบริการให้เต็มจำนวนโดยถือเป็นความรับผิดชอบต่อการจองใช้บริการและให้ถือเป็นการสิ้นสุดของการเรียกร้อง ซึ่งบริษัทฯจะแจ้งให้ผู้เช่าได้ทราบล่วงหน้าก่อนเวลาที่ผู้เช่าได้ระบุไว้ในการจองหากต้องคืนเงิน เนื่องจากบริษัทฯไม่สามารถจัดหารถหรือรถทดแทนให้แก่ผู้เช่าได้

9. ผู้เช่ามีหน้าที่ดูแลรักษารถยนต์และอุปกรณ์ต่างๆของบริษัทฯตามเงื่อนไขในการใช้รถยนต์ของบริษัทฯตามปกติ โดยผู้เช่าต้องขับรถยนต์บนสภาพถนนปกติและไม่ฝ่าฝืนกฎหมายและกฎจราจร รวมทั้งไม่ใช้รถยนต์ไปในทางมิชอบ และผู้เช่าต้องเป็นผู้รับผิดชอบความเสียหายของรถยนต์และอุปกรณ์ต่างๆในอัตราสูงสุดตามที่บริษัทฯกำหนด ผู้เช่าทราบและได้ตกลงตามเงื่อนไขในการจองและการใช้บริการตามเงื่อนไขปกติของบริษัทฯ ผู้เช่าตกลงให้สิทธิ์แก่บริษัทฯในการยกเลิกการบริการด้านการประกันภัย โดยบริษัทฯจะทำการคืนเงินแก่ผู้เช่าในกรณีที่บริษัทฯเกิดความสงสัยในการใช้รถยนต์ของบริษัทฯ และบริษัทฯมีสิทธิเรียกร้องค่าเสียหายเต็มจำนวนที่เกิดขึ้นกับรถยนต์และและอุปกรณ์ต่างๆของบริษัทฯ รวมทั้งผู้เช่ามีหน้าที่นำรถยนต์ของบริษัทฯมาให้พนักงานของบริษัทฯทำการตรวจสอบ และหากบริษัทฯเห็นสมควรในการยกเลิกการให้บริการแก่ผู้เช่ารายนั้น เนื่องจากการใช้รถยนต์และอุปกรณ์ต่างๆขัดกับเงื่อนไขของบริษัทฯ ผู้เช่าให้สิทธิ์บริษัทฯในการยกเลิกการให้บริการได้ทันที แม้ระยะเวลาในการเช่าจะยังไม่สิ้นสุดก็ตาม

10. ในกรณีที่เกิดอุบัติเหตุหรือเกิดความเสียหายขึ้นกับรถที่เช่า, อุปกรณ์ต่างๆหรือทรัพย์สินของบริษัทฯ ผู้เช่ามีหน้าที่รับผิดชอบในความเสียหายซึ่งเกิดจากผู้เช่าเอง, ผู้ขับ, ผู้ขับเสริม หรือผู้อื่นที่ใช้รถยนต์, อุปกรณ์ต่างๆหรือทรัพย์สินของบริษัทฯสำหรับความเสียหายและการสูญหายซึ่งทรัพย์สินของบริษัทฯ โดยผู้เช่ามีหน้าที่ต้องแจ้งให้บริษัทฯทราบถึงความเสียหายหรือการสูญหายดังกล่าวทันทีนับจากที่ผู้เช่าทราบถึงความเสียหายหรือการสูญหายที่เกิดขึ้น โดยผู้เช่าจะต้องแจ้งรายละเอียดความเสียหายหรือการสูญหาย สถานที่ เวลา และคู่กรณี ซึ่งเป็นส่วนสำคัญที่ผู้เช่าจะได้สิทธิ์คุ้มครองจากการประกันภัย ทั้งนี้การประกันภัยจะไม่คุ้มครองผู้เช่าถ้าผู้เช่าไม่แจ้งให้บริษัทฯทราบถึงความเสียหายหรือการสูญหายในระยะเวลาที่บริษัทฯกำหนด หรือผู้เช่าไม่ให้รายละเอียดความเสียหายหรือการสูญหาย หรือผู้เช่าใช้รถยนต์, อุปกรณ์ต่างๆหรือทรัพย์สินของบริษัทฯผิดประเภท หรือผู้เช่ามีเจตนาทำให้ทรัพย์สินของบริษัทฯเสียหายหรือสูญหาย ผู้เช่าต้องรับผิดชอบสูงสุดตามที่บริษัทฯเรียกร้อง

11. ในช่วงวันหยุด เทศกาล หรือช่วงที่มีปริมาณผู้เช่าจำนวนมาก บริษัทขอสงวนสิทธิ์ในการโทรสอบถามยืนยันการรับบริการและชำระค่าเช่า ล่วงหน้า 1-3 วัน ก่อนวันรับรถตามวันที่จอง โดยจะให้ส่วนลดเพิ่มเติมสำหรับการชำระล่วงหน้า เพื่อเป็นการอำนวยความสะดวกและลดระยะเวลาการสัมผัสพนักงานที่หน้าเคาท์เตอร์ และขอสงวนสิทธิ์ในการยกเลิกการจองที่ไม่ยืนยันการรับรถ หรือกรณีที่ไม่สามารถติดต่อได้ตามหมายเลขติดต่อที่ท่านให้ไว้

12. ผู้เช่ายอมรับเงื่อนไขและข้อกำหนดอื่นๆที่มิได้ระบุอยู่ในเงื่อนไขและข้อกำหนดฉบับนี้ ซึ่งเป็นเงื่อนไขและข้อกำหนดตามมาตรฐานของบริษัทฯตามที่ปรากฏอยู่ในอีเมล์ยืนยันการจองและ ด้านหลังของสัญญาการเช่ารถ โดยที่ผู้เช่าจะได้รับทราบ ณ เวลาที่ผู้เช่าลงชื่อในสัญญาเช่าต่อหน้าพนักงานของบริษัทฯ

13. กรณีคืนรถหลังเวลาสาขาปิดทำการ สิทธิคืนรถช้าฟรีจะไม่สามารถใช้ได้ และบริษัทอาจคิดค่าเช่าเพิ่มอีก 1 วัน

ในกรณีที่ทางบริษัทฯและผู้เช่ามีความคิดเห็นไม่ตรงกัน ผู้เช่ายินยอมที่จะปฏิบัติตามความคิดเห็นของบริษัทฯซึ่งถือเป็นการสิ้นสุด
